Adoption order (21 day appeal period)

Pedro May 28, 2019 17:13

So, today our adoption order was finally approved, however we were informed that there is a 21-day appeal period, during which birth parents could still appeal the decision of the court. We were also informed by our adoption agency that from today our child is no longer consider a ´looked after child´and that we are now the legal parents. We have three questions that someone might know the answer to:

-Does anyone know if the appeal that birth parents can now make during the 21 day period is different to the appeals they could make before the adoption order was granted? Is it correct that the appeal they could now make would have to be about any irregularity that the court has made during the process (e.g. not following certain legal steps before approving the adoption order), rather than about why the child should be returned to them?

-Also, if the birth parents made an appeal what would this mean for the status of the child? Would the child be considered again a ´looked after child´while the appeal is being considered by the court?

-If the birth parents made an appeal, would this mean that there would be further court hearings, including another final hearing to re-approve the adoption order?

Many thanks

Just wondering which part of the UK you are in? From what you've posted above I wonder if you are in Scotland rather than England/Wales?

The legal systems are quite different so its probably important to know before answering your question.

Hi John

First of all a link for you to take a look at: Appeals for orders for children - if you scroll down you will see that there is a section on appeals and timescales.

I can't provide you with any direct advice on this, however, I would suggest that you have been informed of this as a result of the last few years where there have been issues around legal rulings and judgements in adoption. Your Court/Childrens Services team may be trying to be careful as a "just in case"

If you need ANY legal advice on this, and are an Adoption UK member, then you can access the Legal Helpline provided within your membership: https://www.adoptionuk.org/membersadvantage

OR, you can make contact with Ridley Hall solicitors who are very helpful in adoption law. https://www.ridleyhall.co.uk/

Alternatively you can contact the Adoption UK Helpline: England - 07904 793 974 or 07539 733079 You can also email them on [email protected]

Best wishes

Scott
