SAP is currently "£135.45 or 90% of your average weekly earnings before tax (whichever is lower)." (you know there's this thing called Google... just kidding).I took all my SAP plus all my accrued annual leave and then went back 2 days a week using up some annual leave for the coming year (entirely off work for about 10 1/2 months). So I'm not quite sure about the transition but given what happened when I went from occupational to statutory it just means your pay will be much lower one month and then stop coming! If you're paying into a pension make sure you have arrangements, if you need them, to pay the missing part. Usually that happens after you go back to work. I got a letter from Payroll explaining all this. Haven't you had one yet? Two months in seems a long time not to get one - I think it was a couple of weeks after I officially started adoption leave that I got it.

I was very interested in reading your reply, I am currently on my adoption leave, 10th month, due back to work in march, but have accrued 7 weeks annual leave, I have never received any letter from my pay role department confirming any of this, I know my work will make it difficult for me to go back, I won't be able to go back full time. I only received £135 per week for the 9 months, no additional monies, does this sound correct? My employers have never had anyone on adoption leave. Thanks for your advice

Legally they only have to give you the statutory pay - I pointed out that my employer's published adoption leave was below legal requirements (basically they'd rewritten the website on maternity but not bothered changing it for adoption). So they just copied and pasted maternity which meant I got the same occupational pay for the first X weeks - they don't have to give you that even if they normally do on maternity. So unfortunately that sounds right. There are legal requirements on how much holiday you have to get and they HAVE to take you back, not into the same role I don't think if you are going on Additional as well. I think they'd have no legs to stand on if they made you go back part time when you were full time before or do you mean it's your choice to go part time? If that's the case they have to consider you in a part time or flexible working role and if they've given someone else at your level a part time role before it's hard to refuse. I had a precedent in my department thankfully so they just said OK.Have a look on Gov.Uk for the legal situation.
