Hi all

Havent been on for a while and i see its all change! Are you now not allowed to pm people now? Weve been up to our ears with everything at the moment as our son who was in private education due to adhd/spd (small class size) long story but he was permanently excluded at the beginning of the year for impulsively grabbing another student. He went to this school with a full ehcp that the school accepted so we wnt to appeal and this decision to exclude was upheld. We went to first tier tribunal(high court) and won but school refused to follow courts order and they went on to appeal to the upper tier. When at the upper tier they were ordered once more to follow courts orders....they didnt and decided to then appeal the main court which was about 3 weeks ago...We won they have to re instate amongst other things problem being though for them is that by going to the main court they have brought the case to the open forum....Our son has closed a legal loophole that will protect others who may find themselves unlawfully excluded. Its been so exhausting but you know what justice prevails!

Wow Westi sending you hugs xxx what a horrendous ordeal for you all xx

So well done for hanging in & fighting xx absolutely soul destroying xx

I salute you this must have been the most awful of times xx....

Do you trust the school ? How do you feel they will treat & support your son xx will they be 'adults' & admit the mistake & help him regain confidence & friendships xx Your poor son this is going to be so hard.... I remain amazed by the lack of conscience & support educational institutions provide our uniquely challenged children xx

Well done for finding the strength to fight & stand up & be counted xx

You are a trailblazer & I thank-you wholeheartly for the new loopholexx

Where did you find your legal team that spearheaded this fight? They sound brilliant xx

Please post some more tactics if you feel you can xxx

Wow again Westi! That is absolutely fantastic and amazing perseverance and strength! We all need (and find) strength for our battles but that is taking it to exceptional levels - well done! Did you get legal aid for this or other support for funding (if you don’t mind me asking) as it would cost a fortune otherwise and might be useful information for others in their battles if in any way similar?

I hope your son settles back at school and they now actually do manage to meet his needs to the best of their ability - and that they have learned in the process - do they need suitable training? That is maybe something you could look into / offer next - as you really do want it to work for your son not just on a superficial level

good luck

Hi westi, the educational system for kids with additional needs is so complicated i think many parents give up. You have challenged the system and taken things up the chain about as far as you can go. Many congratulations on the outcome. ?

We are just finalising an EHC for my son and trying to source provision. I think regardless we are in for a rough ride. Families like yours challenging the system and closing loopholes can make things a bit easier for families like mine earlier in our journey. So genuinely thank you so much.

I am also interested to hear how this may affect your invoice working relationship with the school moving forward. I sincerely hope things move on as smoothly as possible for you. ?
