Adopting from abroad

bellthecat October 26, 2009 13:03
HiI presently work in Germany and live here with my partner of several years who is an Australian. We will shortly be civilly partnered in Scotland and in a little over a year will move to the UK (London) to sell my house before we emigrate to Australia. My partner has always been keen to adopt (as have I more recently) but it is not possible to do here in Germany and will not be possible to do in Australia either. I was wondering therefore whether as a non-resident gay British citizen - would I be allowed to adopt in the UK?Looking forward to some answers Douglas

HelloI understand that to adopt in the UK you need to be ordinarily resident in the UK.I'm not sure how long you'd have to be based in the UK to qualify as being ordinarily resident. However, assuming you and partner returned to the UK and satisfied the residency requirements, were approved and then went on to adopt, there would not be a bar on emigration as such (although if there visitation rights, that might prove a geographical and financial challenge). If emigration was voiced as an aim, some social workers might not view it as compatible with providing a stable and settled environment for a child. Sorry I can't be more help.Ronnie

this is a help Ronnie, and thank you. We wikll be resident in London for about 6 months before emigrating. I am guessing that that will not be long enough. Can anybody confirm?

Hi Bell,No its unlikely to be enough time. You'd need to be resident for a period before applying and then the approval and matching process could take 1-2 years, plus more time before the adoption is formalised.TBH you'd need to be looking at residing here permanently for 4-5 years for it to be a viable option as SS would be wary if you planned to emigrate very soon after adopting and may be unwilling to approve you.Good luck for the future,Midge
