Rights as an employee as a parent with a child with a disability

The service I work for as a teacher is closing and we will have to apply for the new PRU which will open in September.The conditions of employment will be different as well as the structure of the day.Can anyone advise me of, if any, of the rights I have have to some flexibility having a disabled child eg at present we do not start until 9.30. I fear the PRU will have a much earlier start which I am unable to be there for. I am only after a .2 or .4 part time post!

OK, I think you need to speak immediately to your HR rep and union rep, if you are not in a union get in one immediately, they won't deal with your case for firsy six weeks so keep quiet when you join about the current issues. In essence if you can't work the hours it would be seen as constructive dissmisal(sorry can't spell) but you need in writing the reasonable adjustments to meet your caring needs, most of these things are verbal agreements get it written down asap. Also you could relie on custom and practise if you have been there a long time, but decent union rep is the answer. Under the equality Act which covers disability some recent cases have been taken to court that infer rights for carers I don't know the name of the cases but google it. I have just fort and won getting reasonable adjustments for my own disability. If you run into any obstacles straight to MP they do not want anyone on benefits where it can be avoided.Hope some of that helps.

also look on the direct.gov website as i think the 'rules' are different if your children are disabledsuze x

As a minimum you have a right to ask for part time flexible hours as a parent of a child with a disability. In the same way as parents of the under 5's can ask for flexible working, but the right is only a right to ask for flexible working, not a guarantee. As others have mentioned you probably have more rights under your current contract being changed- constructive dismissal etc. so I too would be ringing the union rep if you're in a union (must admit our union membership went up when we were being re-organised).Hope it works outl
