Incapacity Benefit and DLA

I get High Rate care component DLA for myself and also get incapacity Benefit. Am due to have a medical this week in relation to my Incapacity Benefit (Thanks to Mr Cameron). It was only just before Xmas that I got a letter re my DLA renewal saying I had been awarded it for an indefinite period. Does anyone know if they take away the incapacity benefit does that mean I will also automatically lose the DLA too.Am in such a state worrying about the medical, as I have had one before and know that if you can so much as open your mouth they decline you.

not entirley sure but am not convinced the two are directly related. the dla refers to your disability needs and the incapcity to your ability to work (I think). many disabled people work but still received dla. even if they deemed you fit to work and removed the incapacity benefit that doesn't mean you are not disabled anymore, just 'fit' to work. i think. but not an expert. i am just waiting for the day that they call my AS in for one of these 'interviews'! good luck to them is all i can say, but then he wasn't deemed disabled at all when i first applied for it as a non verbal, severely learning disabled, hearing impaired, faecally incontinent and growth restricted 4 year old!! good luck anyway, got enough on your plate without being forced into work you're not able to do as well.

HiI shouldn't think so. I work full time and get high rate mobility DLA. DLA is non means tested and therefore I am def sure that you will not lose it. Good luck for the medical, it must be very frustrating for you. For those that genuinely need the incapacity benefit it is a right pain having to prove it. I work with people who claim it and shouldn't get it (in my opinion..of course!) and they so far haven't been called in for the medical....makes me so cross. These are the people that Mr C should be targeting.Anyhow rant over...All the bestLH

I worked until recently when I eventually had to take medical retirement and I get the highest rate for mobility and the middle rate for help in the house.They are not related to incapacity benefit.You can work and receive DLA benefits.Tiglet

Well after having my medical in August and the decision meant to take 3 weeks, I finally heard this morning that I am to lose my benefit unless I agree to attend a return to work course and show that I am actively seeking employment. I am going to appeal but wont hold out much hope. I honestly dont know how we are going to manage nearly £800 a month less with 2 young children and we are not entitled to any other benefits.

appeal, immediatelyits all about targets, getting people off benefit.as with all these things it seems to hit the genuine applicant not the people who are prepared to lie.

DLA is non means tested and therefore not an income whereas incapacity is the old sickness benefit and is paid when you are unfit for work. I got the same even though I worked in an office so I would imagine it should be ok. You can still get DLA when you work - providing of course the reason for it reflects what kind of work you do x

From what I have read from my ms magazine, the majority of people that appeal win, hopefully that will be the cases if you appeal. Good luck!

HiSorry to hear your news.I have MS and get DLA. After lots of adjustments I was able to return to work and so don't have to claim incapacity benefit. I work for a local authority and as part of my return to work with the medical advisor, she told me it was ok to work and claim DLA(so long as I used it for its correct purpose). Without it I would be unable to continue to work and would lead a very restricted life. I get high rate mobility and am looking at a mobility car, as I had a relaspe which effected one leg. Without a a car I could not work, as I would cannot walk far enough to a bus stop, I would then have to use taxi's etc.Hope my understandings not to long winded.Basically I have my earnings, DLA and because I am on a low wage I do get a top up of working tax credit because of the DLA, so I really donot see how the DLA and the incapacity benefit are connected.Hope this helps and good luck
