Self Employed inequality of the statutory adoption pay (SAP) policy.

If you're self employed you're not entitled to Stautory Adoption Pay (SAP) I've found myself caught up in this from a feeling of being let down by what seems like an unjust loophole in government policy. Why can't those who are self employed gain SAP? I can't answer that, nor can I find out. Does anyone know why? Is anyone aware of campaigns past or present to influence government policy change? Has this been tried before? Could we, as a collective, make a difference especially with adoption being big in the press at the moment due to Her Majesty the Queen? It would be great to speak to others out there, whether you're employed, self employed, unemployed or retired. I'm sure we can all agree this is an adoption inequality.

If you and your partner were both employed, only 1 of you could claim SAP anyway and as you say on your other post that your partner will get the 90% x 6 weeks, then SAP thereafter: that's the norm so you're not losing out. But I agree with the principle - if your partner was also self-employed, neither of you would get anything which is unfair and it should change so that there's financial parity.

Thanks for responding Knight. My partner will be returning to work after the 6 weeks, so the SAP won't 'kick in'. This is where shared adoption leave would be great, if there was parity, as then we would continue to gain financial support whilst my partner returned back to work I would still be able to gain the SAP.

I went through this four years ago when I adopted. I wrote to my MP, who in turn requested Ian Duncan Smith - then with DWP to explain why the discrepancy. I chased it for 2 years but didn't get any further. The only reply i received was from the shadow children secretary telling me that my partner could have paternity leave! I am adopting again, and I have, once again, written to the DWP and asked for a reason for the discrepancy.... surprise surprise - no answer from anyone. AGAIN!
