Changing job before adoption leave

East Riding July 29, 2009 10:12

Wondering if anyone would have any advice re employment law or could point me in the right direction to get info?We are matched with a gorgeous littlie and due at panel in October with intros to start asap after panel. Just found out that my current role at work will no longer exist from the beginning of November and that I will be given an alternative job (same grade and pay). I''m fine with the move but wondered how I will stand as I will be doing job A when I go on adoption leave in October and whilst on leave my job changes to job B. Will they have to keep job B open for me or can they give me any old job when I get back as the job I was doing before I went on leave no longer exists? As you can imagine I am not incredibly career focused at the moment - just counting the days til we become a family - but it is important to us as a family to know that I will be returning to work on my current salary.

Hi there,My understanding is that as long as you employer keeps you on the same pay and conditions, then there shouldn't be a problem.I'm assuming that you have been with your employer for more than 6 months and that you are on a permanent contract. If the change of your role would lead to a change to your working conditions (hours, holidays, etc) your employer should follow appropriate procedures and engage in consultation with those affected. My understanding is that they can't just change pay/hours, etc on whim....unless there are clauses in your contract...or if you're contract is fixed term and is coming up for renewal...You're employer can ask for people to voulunteer to change their terms of employment, but they can't force people to. This is the reason for consultation. Ultimately, if the employer has no other choice but to restructure, it may have to follow redundancy procedures (worst case scenario).Although it won't be your most pressing thought right now, I would recommend that you re-visit your contract and see if there are any caveats (eg, if working hours/pay may be changed with prior notice, etc). The more specific your contract is, the less you need to worry. If you have a job description, all the better because this would have been the basis of your interview as well as the terms on which you ultimately accepted the job.Congratulations on the match - hope everything goes well in October.PPP

Thanks PPP, really helpful. Been with the company a number of years on a permanent contract. No change of pay and conditions associated with the new job so looks like I will be ok.Roll on October!
