Foster to adopt whilst on adoption leave from work

Hi We were planning a 'normal' adoption, but now may have to do foster to adopt (long story!). Both of us work and the plan was: Me to take 12 weeks adoption leave, starting on placement date (my Company would give me full pay for this) Partner to take 2 weeks Paternity Leave (Company will give full pay) Me to return to work and partner to make 40 weeks Shared Parental Leave (6 weeks Company gives full pay, then SAP for 21 weeks (i.e. weeks 19 to 39) and then unpaid. We'd appreciate any advice on the financial circumstances now we may do foster to adopt: does the plan above still work (whilst placement date may move back slightly, it should still be within 2 weeks of original plan)? Is the pay the same (appreciate people can't comment on Company specifics, unless there is no distinction allowed between adoption and foster to adopt)? How would any payments we receive from LA as foster carers be factored in? Would one of us in particular need to receive these payments? What are the tax implications? I am a higher rate tax payer, my partner standard rate. Anything else??? Thanks for any help received.

Foster to adopt is the same as adoption in terms of adoption pay entitlements - and legally has to be treated the same from memory. You will not be entitled to child benefit etc till child is actually placed with you (i.e. after placement order granted). Can't comment of effects of LA foster payments, but as far as tax goes you ar eboth taxed on your income as usual - think foster pyaements are tax exempt b ut foster carer may be able to answer that better.

I just wanted to check what you are expecting your husband to get paid on shared parental leave. You seem to suggest he would get 6 weeks full pay from his company. Are you sure this is correct. My husband and I looked into shared parental leave and my understanding is that shared parental leave is paid at statuatory from the point you move from adoption leave to shared parental leave. So if you have claimed adoption leave at the beginning your husband will be on statutory from when he starts his shared parental leave. I believe only you get any enhanced pay offered by employer. He will get his two week parental leave at the start as normal. Re. F2a adoption pay is exactly the same for that. You will have to register for self-assessment to declare your forsteringn allowance but you are unlikely to pay tax on it. The fostering network can help you with this.
