Foster to adopt leave

I'm currently on leave for our first son on adoption but have also started Foster to adopt on half sibling. How does it work with leave and entitlement. There is a 4 week period which overlaps and my work say I'm not entitled to SAP for both children. Is this right? I thought my leave stopped but SAP continued

I was on adoption leave with my first when my second was placed (January then July) - I didn’t actually think about additional pay / leave as I wasn’t thinking of going back anyway - are you? I just resigned at the appropriate time for the leave with the first. I would have thought you might be entitled to extended statutory pay but not sure - you will need advice - and if on leave an extension of this presumably if going back. Do you not get a fostering allowance with FtA? Mine was a long time ago anyway - over 20years

It's mad cause we keep being told FTA is a new thing and they aren't sure on stuff but it's been around a lot longer. I am planning to go back to work but probably when money stops rather than when my certificate runs out. Fostering allowance has now stopped as it's moved to an adoption placement. Basically my pay for no 1 finished end of March but leave would be June. And cert for no 2 started beginning of March so there is a 1 month overlap

Fostering to adopt aside you are simply running two adoption leaves back to back. Adoption leave for fostering to adopt is still adoption leave on exactly the same terms. My understanding of running adoption leave back to back is that your first adoption leave ended the day your second child was placed. You then start adoption leave number two. So for example: Baby no 2 was placed on week 30 of your adoption leave of baby no 1. You then forfeit the remaining 9 weeks statutory pay you were due to receive for baby no 1. You commence then on week 1 of second adoption leave leaving you your full entitlement of statutory adoption leave (ie 39 weeks). I don’t think you would be entitled to any enhanced payments that your employer offers again (ie. full or half pay for a certain number of weeks.) as that entitlement is usually based on full time earnings in the period leading up to your period of leave but you would be entitled to your full stat allowance again. I could be wrong but if you contact hmrc they are very good at helping in these situations and explaining your rights.
